What this agreement covers.

These Terms of Service ("Terms") govern your access to and use of the website located at humblehomeswi.com (the "Site"), operated by Humble Homes Construction, a Wisconsin-based construction company owned and operated by Josh Sweeney ("we," "us," or "our").

By accessing or using the Site, submitting a contact form, or otherwise interacting with us through the Site, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use the Site.

These Terms cover your use of the Site only. Any actual construction work performed by Humble Homes is governed by a separate, written contract signed by both parties — these Terms do not constitute a construction contract or service agreement.

What this website is.

The Site is an informational website where we describe Humble Homes Construction's services — including new home builds, design-build projects, remodels and additions, kitchen and bath renovations, pole sheds, roofing, and siding/exteriors — and where prospective and current clients can:

  • Learn about our process, values, and team
  • View examples of completed projects
  • Submit a contact form to request a quote or schedule a consultation
  • Find our direct contact information

The Site does not allow you to purchase services online, sign a contract, or otherwise legally bind either party to a construction agreement.

Acceptable use.

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. Specifically, you agree NOT to:

  • Use the Site for any unlawful purpose or to solicit unlawful activity
  • Attempt to gain unauthorized access to any portion of the Site, our servers, or related systems
  • Interfere with the proper functioning of the Site (for example, by introducing malware, viruses, or scraping bots)
  • Submit false, misleading, or fraudulent information through our contact forms
  • Use the Site or its content for any commercial purpose without our prior written permission

We reserve the right to refuse service, terminate accounts, or remove content at our discretion, particularly in cases of suspected misuse.

Opting in to text messaging.

If you check the SMS consent box on our contact form or otherwise explicitly opt in by text or in writing, you agree to receive text messages from Humble Homes Construction at the phone number you provided. By opting in, you acknowledge and agree to the following:

SMS Program Terms

What messages you'll receive: Project status and progress updates, scheduling and appointment confirmations, quote follow-ups, and conversational responses from Josh.

Message frequency: Varies based on your project status. Typically a few messages per week during an active project, and only occasional messages otherwise.

Carrier rates: Standard message and data rates may apply, depending on your mobile carrier and plan.

How to opt out: Reply STOP to any message at any time. Reply HELP for help. You may also call or email us to be removed from our messaging list.

Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages.

Opt-in is voluntary and is never required as a condition of receiving an estimate or other services. We do not share your phone number or SMS opt-in data with any third party for any purpose. Full details about how we handle your information are in our Privacy Policy.

Site content & ownership.

All content on the Site — including but not limited to text, graphics, logos, images, photographs of completed projects, page layouts, design, code, and our trade name Humble Homes Construction — is owned by or licensed to Humble Homes Construction and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print Site content for your personal, non-commercial use related to evaluating our services. You may not:

  • Reproduce, republish, or redistribute Site content for commercial purposes
  • Modify, copy, or create derivative works from Site content without our written permission
  • Use our logo, name, or other trademarks without prior written authorization
  • Remove copyright, trademark, or other proprietary notices from Site content

What you share with us.

When you submit information through the Site (for example, through our contact form), you represent and warrant that:

  • The information you provide is accurate, current, and complete
  • You have the right to share that information with us
  • You are at least 18 years of age, or a legal guardian acting on behalf of someone over 18

By submitting project details, photos, or other information, you grant us a limited license to use that information for the purpose of responding to your inquiry, preparing an estimate, and (if you become a client) completing your project.

How quotes and pricing work.

Any pricing, ballpark figures, or estimates referenced on the Site are illustrative only and do not constitute a binding offer. Actual project pricing depends on scope, materials, site conditions, permits, finishes, and other factors that can only be determined after an on-site consultation.

Written estimates that we provide following a consultation are valid for 30 days unless otherwise stated and become a binding agreement only when both parties sign a written construction contract.

Submitting a contact form does not create a contract for services. A contract is created only when we and you sign a written agreement specifying the scope, price, schedule, and other terms of work.

The Site is provided "as is."

The Site, including all content, is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Site will be uninterrupted, secure, or error-free
  • Warranties about the accuracy, reliability, or completeness of Site content

Photographs of completed projects represent past work and do not guarantee identical results on future projects. Every construction project is unique and depends on site conditions, materials, scope, and other variables.

Nothing in this disclaimer affects the express written warranties we may provide as part of a signed construction contract for actual construction services.

Our liability for use of the Site.

To the fullest extent permitted by Wisconsin law, Humble Homes Construction and its owner, employees, sub-contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including without limitation:

  • Loss of profits, revenue, data, or business opportunity
  • Damages resulting from inability to access the Site
  • Damages resulting from any content on the Site or any third-party site linked from the Site
  • Damages from unauthorized access to your information

This limitation applies regardless of the legal theory under which damages are claimed (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable Wisconsin law, including liability for our own negligence in performing construction services under a separate, signed contract.

The Site is not a construction contract.

Humble Homes Construction is a licensed and insured Wisconsin builder. Our license numbers are listed below and are independently verifiable through the Wisconsin Department of Safety and Professional Services.

Wisconsin Builder Credentials

DCQ-022300148 — Dwelling Contractor Qualifier

Carrying applicable general liability and workers' compensation insurance.

All actual construction work — including but not limited to new builds, additions, remodels, roofing, siding, and pole sheds — is performed under a separate written contract between Humble Homes Construction and the client. That contract governs the scope of work, schedule, payments, change orders, warranties, dispute resolution, and other project-specific terms.

Nothing on the Site constitutes a construction contract, a binding offer to perform work, or a warranty regarding work to be performed on your specific property. Project warranties are defined in the signed construction contract for that project.

Wisconsin law applies.

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-laws provisions.

Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in St. Croix County, Wisconsin or, where appropriate jurisdiction lies elsewhere, the Wisconsin county where the construction project is located. You consent to the personal jurisdiction of those courts.

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.

We may update these terms.

We may modify these Terms from time to time to reflect changes in our business, the law, or for other reasons. When we make material changes, we'll update the "Last Updated" date at the top of this page and, where appropriate, take additional steps to notify you (such as posting a notice on the Site).

Your continued use of the Site after we post changes constitutes acceptance of the updated Terms. If you don't agree with a change, please stop using the Site.
